Kenneth Kwabena Agyei Kuranchie, Editor-in-Chief of *The Daily Searchlight*, has petitioned President Nana Akufo-Addo to remove Special Prosecutor Kissi Agyebeng from office, alleging serious misconduct and breach of duties.
In a letter dated October 18, 2024, Kuranchie contends that Agyebeng’s actions meet the criteria for removal under Section 15(1) of the Special Prosecutor Act (Act 959). Citing this provision, Kuranchie stated that his petition is based on “stated misbehaviour, incompetence, incapacity… and willful violation of the Official Oath and Oath of Secrecy.”
Central to Kuranchie’s complaint is his claim that Agyebeng authorized polygraph testing for approximately 80% of staff at the Office of the Special Prosecutor (OSP) through the U.S. Federal Bureau of Investigation (FBI) rather than Ghana’s National Intelligence Bureau (NIB). Kuranchie argued, “This act, carried out by a foreign agency, not only bypassed national security protocols but also violates the Data Protection Act, as well as the Official Oath and Oath of Secrecy.” He contends that such actions are damaging to Ghana’s economy and security.
According to Kuranchie, these alleged breaches render Agyebeng unfit for his role, urging President Akufo-Addo to act. The president has since referred the petition to the Chief Justice for preliminary review.
This petition follows Kuranchie’s unsuccessful Supreme Court bid in July 2024 to have the OSP declared unconstitutional. His suit against the Attorney General and the OSP argued that the Special Prosecutor Act contravened Ghana’s 1992 Constitution, a claim previously withdrawn but refiled on similar grounds earlier this year.
