Bernard Mornah, the flagbearer of the People’s National Convention (PNC), has taken legal action against the Electoral Commission (EC) after being disqualified from the 2024 presidential race.
The EC stated that errors in his nomination forms, such as incomplete supporter details, improper use of voters from different districts, and inconsistent signatures, led to his disqualification.
In his lawsuit, Mr. Mornah argues that the EC’s actions were unlawful and violated his constitutional rights. He claims the commission did not allow him to correct the alleged errors, which he believes is a breach of due process. His legal team, led by Professor Raymond Atuguba, insists that the EC acted arbitrarily and unfairly.
Mr. Mornah is seeking a court order to reinstate him as a candidate and stop election-related activities, including the printing of ballot papers.
He contends that the EC’s decision contravened Article 23 of the 1992 Constitution, which guarantees fairness in administrative processes.
